Ein Kommentar von Ludwig Bayer.<\/em><!--more--><\/p>\n<p>Karl Valentin ahnte, dass jedes Ding drei Seiten hat: eine gute, eine miserable und eine komische. Der Wille zur Freiheit z\u00e4hlt zu den besten Eigenschaften der Menschen. Noch dazu, wenn ein Vork\u00e4mpfer der B\u00fcrgerfreiheit rangh\u00f6chster Richter war: bis 2010 stand Hans-J\u00fcrgen Papier an der Spitze des deutschen Bundesverfassungsgerichts. Heute kritisiert er jene graue Seite der Coronakrise, von der er als Nichtarzt am meisten versteht. Er sieht Freiheitsrechte bedroht. Jeder Satz, den er spricht, kann wie ein Skalpell wirken. (Ein metaphorischer Bezug zur Medizin.)<\/p>\n<p>Gesundheitsschutz sei zwar Aufgabe des Staates, sagt Papier, dies rechtfertige aber bei weitem nicht jeden Freiheitseingriff. Nicht die&nbsp;Lockerungen seien rechtfertigungspflichtig, sondern die Beschr\u00e4nkungen der Grundrechte: \u201eWir m\u00fcssen uns dar\u00fcber im Klaren sein, dass Sinn und Zweck eines Verfassungsstaates in erster Linie der Schutz der Freiheit ist\u201c. Wir sollten nicht einen Tag l\u00e4nger als erforderlich auf Freiheiten verzichten m\u00fcssen. Und: \u201eIch stelle mit Bedauern fest, wie wenig der Gedanke der parlamentarischen Demokratie derzeit \u00fcberhaupt eine Rolle spielt\u201c. Die Macht liegt in der Tat so sehr in den H\u00e4nden der Exekutive und ihrer Beamtenheere, dass die frei gew\u00e4hlten Parlamente peu \u00e0 peu in die Rolle von Statisten am B\u00fchnenrand gedr\u00e4ngt werden.<\/p>\n<p>Die Volksvertreter haben ihre Rechte zu wahren. Jede geplante Regulierung geh\u00f6rt ins Parlament:&nbsp;zu pr\u00fcfen&nbsp;ist, ob wirklich zweifelsfrei feststeht, dass sie unabweisbar notwendig ist. Die beste Pandemiebek\u00e4mpfung liegt nicht in teils komisch-widerspr\u00fcchlichen&nbsp;Vorschriften. Richtig w\u00e4re vielmehr, mit allen verf\u00fcgbaren Mitteln auf dem Weltmarkt und&nbsp;durch eigene Produktion Impfstoffe zu beschaffen. Rasch kann es dann&nbsp;gelingen, einen Durchimpfungsgrad von 70 Prozent zu erreichen. Sobald \u00d6sterreich an dieser Immunisierungs-Zielmarke anlandet, schl\u00e4gt die Stunde der Legislative. Alle Abgeordneten sollten rasch noch einmal die Verfassung lesen und binnen eines Tages s\u00e4mtliche Einschr\u00e4nkungen aufheben \u2013 sodass gl\u00fcckt, was ihre W\u00e4hler wollen: Freiheit.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Wie bedroht sind die Freiheitsrechte?
